Gabriel Quadri must delete transphobic messages from Twitter: TEPJF

Salma Luévano, Morena's deputy, denounced the panista for political gender violence, so she requested the precautionary measures, which were first denied by the INE

After the various controversies and complaints against Gabriel Quadri, a deputy of the National Action Party (PAN), over transphobic statements and messages on social networks, the Electoral Tribunal of the Federation Judiciary (TEPJF) ordered him to remove them.

The High Chamber of this body revoked the agreement issued by the Complaints and Complaints Commission of the National Electoral Institute (INE), which declared the request for adoption of precautionary measures submitted by the legislator of the National Regeneration Movement (Morena) inadmissible, Salma Luevano Luna.

This remedy was demanded by the Morenista due to alleged acts of gender-based political violence by the panista, who on different occasions threw himself against her because of her identity as a transgender woman.

The decision of the TEPJF was taken from the proposal of Judge Indalfer Infante Gonzales, who determined that, since these are messages using distinctions based on “a suspicious category”, concerning gender identity, precautionary measures are appropriate with regard to certain messages that may be discriminatory.

It was noted that these characteristics are considered sufficient to warn the need and urgency of action to eradicate these attitudes. “The adoption of preventive protection is intended to prevent the worsening of the situation of vulnerability of trans people, who belong to a group at risk, corresponding to the substantive pronouncement the analysis of the category of the subject denounced, its significance to the electoral matter and its possible responsibility for the commission of unlawful conduct”, the Court's communiqué reads.

For this reason, the High Chamber asked Gabriel Quadri to remove some messages posted on his Twitter profile, which were denounced, in addition to refraining from publishing or issuing pronouncements “identical or similar in which categories that are likely to be discriminatory” are used.

The only judges who voted against that determination, recorded in the SUP-REP-72/2022 file, were Felipe de la Mata Pizaña, Felipe Alfredo Fuentes Barrera and Janine Otálora Malassis.

In previous weeks, MP Salma Luévano filed a complaint against Gabriel Quadri for issuing messages against her identity as a transgender woman. These statements caused the morenista to hold different protests, such as shaving or dressing as a panist and presenting herself in that way in the Chamber of Deputies.

The repercussions were not only at the national level, as the representative of Acción Nacional was expelled from a foreign program in the middle of the broadcast because in his speech there was a “hate speech” against the transsexual community in Mexico.

Subsequently, a contingent of trans women, convened by Luévano, attended the Lower House to demand Quadri's lawlessness for promoting hate speech against a particular sector of the LGBT+ community.

Under the slogan “Here is the trans resistance!” , condemned the continuing attacks on their community prompted by a discriminatory speech by the PAN deputy, who even referred to this sector as “men dressed as women”.

Finally, the deputy from Morena, on March 2, filed the complaint against the panista before the INE for Political Violence Against Women based on Gender.

Through her social networks, she made her complaint public and wrote: “Today I filed a complaint with the @INEMexico of Political Violence against Women for Gender Reason, against @g_quadri because transphobic speeches addressed to me that hinder my legislative work and with them, those of our entire population”.
