Fonavi 2022: Law published for the immediate implementation of the return of contributions

The Act specifies who will make up the Ad Hoc Commission and who will provide the infrastructure and resources necessary for the functioning of the Commission.

The Congress of the Republic promulgated the law that ensures the implementation and execution of the return of money from the National Housing Fund (Fonavi) to workers who contributed to the same, prioritizing the vulnerable population, as a result of the covid-19 pandemic

Law No. 31454, published in the Legal Standards bulletin of the Official Gazette El Peruano, states that this regulation is intended to ensure the immediate implementation and execution of Law 31173, which ensures compliance with the Fonavi Money Back Act.

The rule refers to the constant value of contributions by applying the consumer price index corresponding to the period between the start of each individual contribution until the date of its return.

Similarly, article 5 of Law 31173 specifies, in the sense that the Ad Hoc Commission is composed of:

- Three representatives of the Ministry of Economy and Finance (MEF).

- A representative of the Office for Social Security Standardization (ONP).

- Three representatives of the National Federation of Phonavists and Pensioners of Peru (FENAFP).

The Commission is chaired by one of the representatives of the National Federation of Phonavists and Pensioners of Peru.

The Presidency of the Council of Ministers (PCM) provides the infrastructure and resources necessary for the functioning of the Commission.

It is also specified that the Technical Secretariat for Support to the Ad Hoc Commission created by Law 29625 will be transferred as such to the PCM and shall ensure the continuity of the functions, operations, processes and procedures for the fulfillment of the purpose of this Act.

Likewise, it is indicated that the SAC Materials Bank, in liquidation, will continue to administer the Revolving Fund until its total transfer to the Ad Hoc Commission created by Law 29625 and amended by this Act.

Finally, the only supplementary amendment provision of Supreme Decree 090-2021-PCM, the Supreme Decree approving the change of dependency of the Technical Secretariat for Support to the Ad Hoc Commission created by Supreme Decree 006-2012-EF, from the MEF to the PCM, is withdrawn.

The norm is endorsed by the president of the Congress of the Republic, María del Carmen Alva, and the first vice-president of the Congress of the Republic, Lady Camones.
