Sergio Fajardo and the Centro Esperanza Coalition ratified their support for Murillo as vice-presidential formula

According to information from Caracol Radio, Luis Gilberto Murillo Urrutia, former Minister of Environment and Vice-Presidential Formula of Sergio Fajardo, is underway in the Bogotá courts against the Ministry of Defense, the National Police and the DIJIN to have his judicial records deleted.

What Murillo seeks is that a six-month prison sentence is no longer registered when he was director general of the Regional Autonomous Corporation for the Sustainable Development of Chocó, Codechocó.

The genesis of the trial is given by the judgment handed down by the Dual Criminal Decision Chamber of the Superior Court of Quibdó on August 29, 1997, for the crime of embezzlement by different official destination, which was configured by having allocated five million pesos for locative reparations in the Pascual educational institution from Andagoya, in Chocó.

The arguments of Murillo's defense, in the guardianship being studied by the Administrative Court 38 of the Bogotá Circuit, are supported by article 15 of the Constitution, which talks about the right of individuals to the protection of “habeas data” and the possibility that they have to ask the authorities to update and/or rectification of information collected “in data banks and archives of public and private entities”.

“The permanence of these data in the database on criminal records cannot be timeless,” argues the former minister in his guardianship and asks Interpol, the Ministry of Defence and the National Police to 'relative suspension' of the data related to judgment 20 of August 29, 1997 that he records in the database of criminal record and that a new letter be issued to the Colombian Renaissance Party that does not include the negative data associated with that judicial decision.

According to information from Caracol Radio, Murillo's press chief reiterated that the Criminal Cassation Chamber of the Supreme Court, in a decision of August 3, 2005, acquitted the former minister for the crime of prevarication allegedly committed when he was governor of Chocó January 1, 1998 and January 23, 1999.

In an interview with Semana, Murillo said that “There was already a decision by a judge who precisely lifted those disabilities, including the one they mention there, timeless, with very concrete arguments. This is a process that has several stages, but what needs to be clear is that it is an issue that has been overcome, that the disabilities were lifted, including the timeless one, because it is a crime that was never committed, on the one hand, and on the other because they have changed, there has been a whole approach of favourability”.

For his part, Sergio Fajardo, through a statement signed by the five pre-candidates of the Centro Esperanza Coalition and Juan Fernando Cristo, political director of the Fajardo campaign, denied the accusations and showed support for Murillo.

In the document they emphasize that official information clears any doubt of an inability, “there is no disability of Luis Gilberto Murillo. Official information on this subject unequivocally indicates that he is entitled to aspire to any popularly elected office.”

In addition, they add that the case was a political attack against its vice-presidential formula perpetrated by its contradictors. “The case in question arose several years ago because of the discomfort that Luis Gilberto Murillo meant to the political clans of the department of Chocó,” said the Esperanza Center Coalition in the statement.

In this way, the Centro Esperanza Coalition said that it supports “with all enthusiasm and conviction Luis Gilberto Murillo as a candidate for the Vice Presidency.”
