Because they allegedly did not pay the portfolio recovery fees to the law firm Mola Lawyers Group S.A.S., the liquidation process of the extinct Electricaribe was provisionally suspended by decision of the Bolivar Administrative Court.
According to the regional newspaper El Heraldo, the ruling was made in February, but it became known recently as the company of lawyers intends to obtain a millionaire sum after the execution of the contract with which they would carry out the process of charging defaulters was prevented from being carried out and due to irregular connections in the towns where the former electricity company in the north of the country lent.
In the barranquillero newspaper they cited one of the parts of the ruling: “The contractor was unjustly deprived of his right to perform the contract under the agreed conditions, and by the non-liquidation of the contract in the post-contractual stage, his right to credit, which was the expected gain, was injured.”
Until this lawsuit is resolved, with the Mola Lawyers Group S.A.S. seeking recognition of what is owed to them, apparently, in four years of work, the process of liquidation of Electricaribe will be suspended, they also highlighted on the La W Radio station.
Meanwhile, in the newspaper El Universal in Cartagena they reported that the ruling of the Bolivar Court also provided for the suspension of the other outstanding payments in Electricaribe, with some exceptions.
“To partially suspend the execution of the liquidation process in accordance with paragraph 2 of article 230 of the Cpaca, immediately ceasing payment to all creditors, except in relation to the payment of labor, tax and administrative expenses of any kind,” they cited from the ruling in the Cartagena medium.
While in El Heraldo they also mentioned that in order to guarantee the payment of what is due, in the Bolivar Court they ordered the establishment of a legal reserve of 28 billion pesos, that is, the same amount that is intended in the lawsuit of Mola Lawyers.
In that media outlet they explained that in the administrative process the Superintendence of Public Services and the liquidator of Electricaribe will have to respond, because the same could be repeated against them in the event that a ruling was made against the State.
“I seek to declare the breach of the contract, since it was terminated and arbitrarily by the current liquidator of the Electricaribe without justifying the established grounds,” the owner of Mola Lawyers said in that newspaper.
Finally, in El heraldo they consulted with the Superintendency of Public Services where they indicated that at the beginning of March they filed the appeals for reinstatement and appeal, which must be admitted by the Bolivar Court and subsequently decided by the Council of State. This is because the Superintendency carried out the possession of assets, assets and businesses of the extinct electrifier company.
On Caracol Radio they mentioned that the representative to the Chamber for Atlantic, César Lourdoy, assured that the ruling was immediately complied with, but that users would not be affected. However, the congressman acknowledged that the process of liquidation of Electricaribe will be delayed any longer and no efforts can be concentrated to improve the provision of this service in that area of the country.
Since March of last year, the Caribbean electrification company entered into liquidation due to repeated complaints about the poor provision of service in the populations of this region of northern Colombia.
