Carlos Garcia, stepbrother of Mauricio and Jhonier Leal, asked to be recognized as a victim in the trial

On March 29, a hearing was held in the case of Jhonier Leal, who confessed to murdering his brother Mauricio Leal and his mother, Marleny Hernández. In the new process, the answers to the pre-agreement reached with the Office of the Attorney-General of the Nation were made known. The stylist could also receive a reduction in the penalty, according to the information provided in the 25-sheet file and in total would be sentenced to 27 years in prison.

“In the verification of cameras of the set it can be seen that on Saturday, November 20, 2021 it will be 09:59pm MAURICIO LEAL HERNANDEZ entered to his residence. Similarly, around 10:52 p.m., he arrived at the residential complex ARBORETTO YHONIER LEAL. On Sunday, November 21, 2021, they had breakfast and shared part of the day, until 12:48 p.m. when it leaves the residential complex YHONIER LEAL, bound for the KOKORIKO which is located on Calle 71 No. 9-06 where he bought some combos and returns to the set at 2:10 p.m.”, can be read in the pre-agreement.

It states that by accepting the charge of aggravated homicide in conjunction with the crime of concealing, altering and destroying evidentiary material, “the Prosecutor's Office, as the only benefit, grants him a reduction in sentence under article 351 of the Criminal Code, which may go up to half”.

“After these macabre events, he was responsible for modifying the scene by cleaning and transferring the mother's body from the third sublevel to Mauricio's room (...) carrying the evidence (wearing gloves) in order to make it appear that it was a suicide,” the document states.

The document also notes that, “It is observed by the employees of the house, that several things were not in their usual place and others were not found, such as blankets replaced by new ones, a PUFF furniture that was from the room of Mrs. MARLENY HERNANDEZ and that was found in the room of MAURICIO LEAL, a filing cabinet which was also found in MAURICIO's room and should be in another place and a white rag that was found on the terrace of Mrs. MARLENY's room”

On the other hand, Carlos Andrés García, stepbrother of Mauricio and Jhonier Leal, is deprived of liberty in a prison in Jamundí (Valle del Cauca) for the crime of sexual abuse of children under 14 years of age. He recently became acquainted and asked the 55th Court of Knowledge of Bogotá to be recognized as victims in the process being carried out against Jhonier Leal.

Through her lawyer, María Paula Cardona, she submitted her formal petition to be recognized as victims in the process. In the pre-agreement signed by Jhonier Leal with the Prosecutor's Office, only relatives Maria Kelly, Maria Diner and Duvier Tabares, brothers of Marleny Hernández, are cited, who insist that Jhonier must also be charged with torture. The hearing had to be rescheduled for next Friday, April 22.
