
The president of the Council of Ministers, Aníbal Torres, spoke out against it again the ruling of the Constitutional Court (TC) in favor of Alberto Fujimori, which reinstates the humanitarian pardon granted in December 2017. On this occasion, he compared the former president to the dictator Adolf Hitler.
He gave these statements from Cusco, where he explained that, although the Nazi leader turned Germany into a world power, he was still condemned for the crimes he committed. “A person is judged for the wrongdoing they commit,” Torres said in relation to the La Cantuta and Barrios Altos cases.
“Let us be human beings, how is it that we can tolerate those who allowed students from La Cantuta to be kidnapped, these students mistreated, burned, dismembered and buried clandestinely on a road from Lima to Cieneguilla. Would you like them to do that to your daughter, your son? Why are they other people's children can you stay calm, saying that (Fujimori) did a lot of good for Peru?” , he said.
“We must recognize his good deeds, but I give them as an example: in Germany was it not Adolf Hitler who made him a world power? It was him, but he was condemned, not only by the Germans, but by the whole world, for the great crimes he committed. No one is judged -judicially- for his good works, he is judged for evil deeds,” he continued.
Similarly, the prime minister stated that the Executive is studying the legal possibilities to annul the TC ruling , which he considers to be a mistake. Finally, he indicated that they have the support of international agencies.
COMPARED TO TUPAC AMARU AND FRANCISCO BOLOGNESI
The Habeas Corpus presented to the Constitutional Court by Ica's lawyer, Gregorio Parco Alarcón, in search of releasing Fujimori Fujimori, compares the one sentenced for the crimes of qualified homicide, enforced disappearance, aggravated kidnapping, corruption, among others, with heroes of the homeland, as they are Francisco Bolognesi and Tupac Amaru.
In the appeal, among other arguments, it is considered that “having an 82-year-old person in prison, who is ill in health, is no longer a danger to society, it is like having the HEROES MUERTO TUPAC AMARU II, enemy of SPAIN, FRANCISCO BOLOGNESI, enemy of Chile, imprisoned in spirit”. This was revealed by journalist Carlos Villarreal on his Twitter account.
In addition, Parco Alarcón's request argues that Alberto Kenya Fujimori Fujimori Fujimori's “personal integrity, and the right not to be subjected to torture or inhuman or humiliating treatment, environmental pollution and coronavirus” is being violated.

“CONSTITUTIONAL COURT MUST DISAPPEAR”
Minutes after learning that Alberto Fujimori will leave the Barbadillo prison, located in Ate, in the coming days, Aníbal Torres declared to Exitosa that the Constitutional Court must disappear as it only serves as “the champion of the impunity of the great criminals”.
“This shows that in Peru the most experienced criminals have fundamental rights. The whole of Peru knows that this man was convicted of very serious crimes, he is not only sentenced for murder but also for aggravated kidnapping. Unfortunately, the Constitutional Court becomes the champion of impunity for big criminals [...] I have always ruled that this body must disappear,” said the premier.
“What the TC does is make it known that it guarantees impunity for criminals with a certain power, where are the families of Barrios Altos, La Cantuta, serious crimes, where they were kidnapped, burned alive, buried clandestinely. Such a decision cannot be made for crimes of this nature. (...) This body should not exist, it must disappear, we must change the concentrated control of CT to diffuse control, that is, that its functions are done by the Supreme Court,” he added.
