Javier Lozano lashed out at Minister Yasmín Esquivel: “The court at the feet of the tyrant”

“What a shame! ”, this is how Javier Lozano Alarcón, a member of the National Action Party (PAN), reacted to the work of Yasmín Esquivel Mossa, Minister of the Supreme Court of Justice of the Nation (SCJN), after granting a suspension in favor of the Office of the Attorney General of the Republic (FGR).

Through his official account, the former head of the Ministry of Labour and Social Security (STPS) indicated that the highest Mexican court is supposedly at the “feet of the tyrant”, that is, that it has allegedly become servile to the interests of President Andrés Manuel López Obrador (AMLO).

The words of the poblano politician were in response to a note from Infobae México, in which it was announced that Minister Esquivel Mossa stopped the delivery of the investigation kits against Pío López Obrado r, brother of the Mexican president.

According to the rapporteurship offered by the SCJN, the decision was taken because, if the action requested by the National Electoral Institute (INE) was granted, human rights would be violated, especially those concerning the protection of personal data, as well as respect for due process, situations that are due to protect according to the Political Constitution of the United Mexican States (CPEUM).

However, the former official was not the only one who lashed out against the minister, since last Wednesday, 20 April, Senator Lilly Tellez also did so, who accused the Doctor of Law of alleged obstruction of justice in favor of Pío López.

Through her official Twitter account, the legislator for the state of Sonora said that the act carried out by the minister should be identified as an act of “obstruction of justice”, and therefore stressed that it should be condemnable for a person dedicated to justice to act, allegedly, at the request of the head of the FGR, Alejandro Gertz Manero.

In addition, he elaborated on his remarks and ruled that such an act responded to wanting to “hide” the alleged acts of illegality that have taken place in the environment of President Andrés Manuel López Obrador (AMLO), so he called them a “ball of leperos”.

It is worth remembering that it was in 2020 when the electoral body asked the FGR's Office Specialized Prosecutor for Electoral Crimes (FEDE) for the folders opened for the presumable acts that these actors did when they received money for political campaigns.

However, the Public Prosecutor's Office refused and explained that it was due to an ongoing investigation, and hence providing the information would correspond to a direct violation of the Political Constitution of the United Mexican States (CPEUM).

The proposal of Judge Janine Otálora Malassis and Presiding Judge Reyes Rodríguez Mondragón, the plenary session of the Superior Chamber determined, by a majority of five votes in favor and two against, that the sentence was not complied with by the FEDE, as copies of the requested research kits have not been handed over to the INE .

For this reason, the Institute appealed to the Electoral Tribunal of the Federation Judiciary (TEPJF) to challenge the decision, which stated that the Prosecutor's Office should accede to the petition; before which, the unit in charge of Gertz Manero filed a constitutional dispute.
