Afore: how many beneficiaries can be registered to receive the resources in the event of death

Given a rise in people who have died in recent months due to the COVID-19 virus, it will be important to take into account their beneficiaries of your Afore, that is, those who will be able to collect their resources in the event of their death.

In this regard, the National Commission for the Savings System for Retirement (Consar) recalled how many people a worker may register as beneficiaries.

How many beneficiaries can be registered?

According to Consar, a person may register up to 5 beneficiaries, whether minors or adults.

And it is that the people who are elected will be entitled to a pension and, therefore, to dispose of the resources of the Individual Account in the form of said pension or in a single exhibition.

Who are they?

- Widow or widower, if they have depended on the deceased worker.

- Children under 16 years of age or older than this age if they cannot support themselves by their own work, or if they are studying until the age of 25.

- Parents of the worker if they have lived in the same home as the deceased.

- In the absence of a spouse, the concubine or the concubine may also collect the amount of the afore, if the latter depends financially on the worker.

The only requirement to recover the resources is to be entitled to a pension by the IMSS or to have been expressly designated beneficiary by the holder in his afore.

Those who wish to start the procedure should follow this procedure:

1. If you are a legal beneficiary, you go to the IMSS Sub-Delegation to have the corresponding Pension Resolution issued.

2. The interested party must go to the Afore where the deceased worker was registered with the documents accrediting you as a beneficiary and fill out the Resource Disposition form that will be provided there.

If workers were pensioned under the Social Security Act 73, the resources will be delivered in accordance with the following statutes:

- Retirement 97 (resources accumulated from 1 July 1997 to date)

- Housing 97 (resources accumulated from 1 July 1997 to date)

- SAR 92 (cumulative resources from 1 May 1992 to 1 July 1997)

- Housing 92 (cumulative resources from 1 May 1992 to 1 July 1997)

On the other hand, if the pension is under the Social Security Act 97:

- SAR 92 (cumulative resources from 1 May 1992 to 1 July 1997)

- Housing 92 (cumulative resources from 1 May 1992 to 1 July 1997)

How to apply?

*The interested party must go to the Subdelegation of the Mexican Institute of Social Security (IMSS) or the Economic Benefits Institute of the Institute of Social Security and Social Services of State Workers (ISSSTE), in order to issue the pension resolution.

According to Consar, only the Single Population Registration Key (CURP) is required for the procedure.

If you are a Substitute Beneficiary, you must go to the Federal Conciliation and Arbitration Board or Tribunal to obtain the award that designates you as the beneficiary, or go to the Federal Attorney's Office for the Defence of Labor (Profedet) for free legal advice.

*Subsequently, you will have to attend the Afore where the deceased worker was registered and fill out the Resource Disposition form provided by the Administrator.
