According to the footballer's lawyer, this process should not be carried out in Peru because the children and Génessis Alarcón have residence in the United States, so his lawyer requested that the court declare the exception for incompetence and conclude this process. This request greatly outraged the journalist, which is why she pointed out that Andy Polo “sells himself as a good father, but does a good father want to dismiss the demand for food for his children? I guess no judge in his right mind is going to prove him right.”
It should be noted that for this request to be effective, Andy Polo's lawyer presented the U.S. green card of Andy Polo's still-wife and their children, as well as the health insurance that pays for it in the North American country. It also indicates that Génessis Alarcón seeks to manage the money that is due to her children through this process, so she too should work to generate her own income.
