
The controversial activist of the National Action Party (PAN), Javier Lozano Alarcón, lashed out against the head of the Financial Intelligence Unit (FIU) of the Ministry of Finance and Public Credit (SHCP), Pablo Gómez Álvarez, after questioning the Institute National Electoral (INE) the scarce installation of boxes in the Mandate Revocation Consultation.
Through his official Twitter account, the former Secretary of Labor and Social Security (STPS) declared that the former perredist wants to assume functions that do not belong to him as head of the Financial Unit.
In the message, the Mexican politician stated that Gómez Álvarez attacks the electoral body with “crooked” legal bases and without understanding what the principle of legality is, so he described his performance as “a shame.”
And it is that on April 12, Pablo Gómez reproached the Electoral Institute for not having informed Mexicans that the vote in the Revocation of the Mandate of the President Andrés Manuel López Obrador (AMLO) was mandatory.
On his social network, the head of the Financial Intelligence Unit recalled that article 35 of the Constitution establishes that all citizens have the obligation to vote in elections, popular consultations and the revocation of mandate processes; while article 38 mentions “the sanction for not doing so.”
In the publication, the official also questioned the INE about the scarce installation of boxes it deployed for the consultation on April 10, and accused the agency of its unavailability to carry out the organization of the consultation.
“The Constitution (35.I) makes voting mandatory in the revocation of the mandate. The 'electoral authority' never made it known to citizens because it was against the procedure. There were not all the boxes because the INE withheld $1 billion in its illegal trusts,” he wrote.
In view of this, the National Electoral Institute assured, on 14 April, that the two trusts it has are protected by law, and accompanied his message with a rebuttal to Pablo Gómez, without mentioning it expressly, when he wrote: “Whoever says that the INE could put more boxes with that money, lies.”
The INE explained, in a statement, that the trusts it has, both the Fund to Meet Labor Liabilities and the Fund for the Fulfillment of the Real Estate Infrastructure Program, cannot be used for a purpose other than the one they were created.
This is due to the fact that the Federal Law on Budget and Fiscal Responsibility establishes in article 11 that “the unit responsible for the agency or entity from whose budget the resources have been allocated, or which coordinates their operation, shall be responsible for their application for the purposes for which it was constituted the trust”.
“Altogether, the trusts have a balance of 1,353.09 million pesos, of which only 626.15 million pesos are available, but cannot be used for purposes other than those specified,” he added.
However, only a few minutes passed for Gómez Álvarez to respond on Twitter, as he declared that the Electoral Institute has these trusts, proves their illegal nature, since the body is not a social security institution that must provide protection to its workers or a real estate fund.
