What is political gender violence, a crime for which Chumel Torres is accused

The controversial detractor of the current government of Andrés Manuel López Obrador, Chumel Torres, is currently involved in a conflict because the Attorney General's Office (FGR) opened against him a research on political gender violence.

This was announced by Bertha Caraveo, Senator for Chihuahua de Morena, who since previous dates had explained from her social networks that she filed a legal remedy to prevent other women from suffering machismo and hatred from the influencer.

“That by means of this writing in my capacity as a citizen I come to file a formal complaint for crimes that constitute the conduct that affected my human dignity, due to the gender-based violence to which I have been subjected in a media way against José Manuel Torres Morales”, can be read in the copy of the complaint of the Senator of Morena.

The triggering event arose after the Pulse de la República driver insulted the senator on his program and referred to her in a derogatory tone.

“This stupid*, ah! , I told him stupid*, I meant him moron, it's Bertha Caraveo, senator of Morena from Chihuahua. The dick takes me! Madam, all the more dragged and slimy, and the shell grows, mija, eh! After the formal complaint, the communicator came out to defend himself and shared a post from his Twitter account.

“Freedom of speech? No. Not here. There is no such thing here,” he said from the tweet that he also had a 50-second video.

“The Pulse doesn't have a single head, it's not me, it's a hydra. And if you cut off his head, he grows seven more, sons of his p*nche mother.” After saying that he comes from Chihuahua, a state where people face adversity, he declared “Let yourself come, let yourself come, there is still a lot of p*nche north to these veins”, you can hear it in the audiovisual.

According to the General Law on Women's Access to a Life Free of Violence in article 20, gender-based political violence against women can be understood as “any action or omission based on gender elements and exercised within the public or private sphere, which has the purpose or effect of limiting, canceling or impair the effective exercise of political and electoral rights by one or more women”.

In this regard, it could be pointed out that not all political violence is caused by gender and therefore the legislation mentions that these actions and omissions can be attributed to a gender issue when “a woman is directed because of her status as a woman” and affect her disproportionately or have a differentiated impact on it.

According to article 159, 163, 415 and 463 of the General Law on Electoral Institutions and Procedures (LGIPE), the General Council may order the immediate suspension of any political or electoral propaganda on radio or television and other legal systems “whose content identifies gender-based violence against women.

In addition, if the offence is proven, the resulting authority will have to consider ordering comprehensive reparation measures to the victim, which may include: compensation, immediate restitution in the event that she is forced to resign on grounds of violence, public apology and non-repetition measures.
