Morena still has no candidate for governor of Oaxaca; TEPJF to discuss Susana Harp's challenge

Despite the fact that Solomon Jara was elected in the internal selection process, the Court sees possible political violence against the legislator

Although Mario Delgado, president of Morena, has stated on more than one occasion that Salomón Jara is already the party's candidate for the governorship of Oaxaca, on Friday night the Superior Chamber of the Electoral Tribunal of the Federation Judiciary (TEPJF) opened the door to the challenge posed by Senator Susana Harp, who also aspires to be the standard-bearer.

In a statement, TEPJF reported that it overturned part of the Oaxaca Local Court's determination regarding the possible existence of gender-based political violence against Harp during the internal selection process in which Jara was elected.

In addition, it ordered that the State Electoral and Citizen Participation Institute of Oaxaca (IEEPCO) be sent to the State Electoral and Citizen Participation Institute (IEEPCO), to resolve through a special sanctioning procedure, according to the draft agreement of Judge Felipe de la Mata Pizaña, who will discuss the plenary session in its public session on March 30.

“The grievances are partly founded, because although Morena formally complied with the principle of parity, it is also true that it lacks internal regulatory mechanisms to achieve substantive parity with a transversality approach to candidates for governor or governor,” the 37-page text states.

Although Salomón Jara is the winner under the method chosen by Morena, the Court noted that there are no regulatory mechanisms in the party that foresee what should be done in this type of case and thereby fulfill its duty to ensure substantive parity through criteria of competitiveness and transversality, especially for candidates for governor or governor.

It is worth mentioning that the legislator has made clear her interest in knowing whether the nomination of Morena's candidate to the Oaxacan government was defined by parity. “That's all I ask to know,” he said. The candidacy is still on the air.

Given the facts, the party founded by AMLO was ordered to define clear rules specifying how to apply transversality or competitiveness in order to ensure substantive parity at the latest at the beginning of the next electoral process for governments.

And it linked the National Electoral Institute (INE) to supervise that the political party issues such rules of substantive parity, in addition to the fact that it must verify that, in the registers of its candidacies, it meets these criteria.
