The defense of former vice president of Ecuador Jorge Glas said he presents “a major depressive disorder with psychotic symptoms” to achieve his freedom

After more than four years in prison after his conviction in two cases for corruption, he managed to get out of prison to serve the rest of his sentence at home.

The court record of the hearing in which Jorge Glas, former vice-president of Ecuador, was granted the appeal of habeas corpus reveals the arguments that the defense presented before the judge for the politician Correista to regain his freedom, after spending more than four years in prison serving two sentences for crimes of corruption.

According to the court summary, one of the doctors who testified at the hearing referred to the state of health of the former vice president and assured that he has pictures related to psychiatric illnesses caused by the trauma of being in a prison: “The patient (Jorge Glas) has had pictures that hallucinate, many times has reported that he sees blood on the walls when there is none, insects and that he hears voices that speak to him at night, in the morning, all day. This is a traumatic effect after the bloody events provoked in the prison,” said the specialist.

A German psychiatrist, who participated in the hearing, said that in 2017, when Glas was arrested, he was already suffering from mild anxiety. But after remaining in prison, the condition of the former vice president of Rafael Correa has worsened. According to the doctor, Glas has “a serious psychiatric condition, a major depressive disorder with psychotic symptoms”. Faced with this state of health, doctors assured that, in prison, Glas did not receive adequate psychiatric treatment: “He receives medication with interactions, permanent medication changes that do not seem rational to me. In conclusion, he is in an environment where his psychiatric disorders cannot be cured, he is with people who are victims of permanent torture,” said the expert.

Among the recommendations given by the psychiatrist at the hearing is that Glas undergo treatment outside prison with a psychotraumatologist. In addition, he warned that “there is a high risk of suicide” due to the mental condition of the former vice president.

On December 31, as Glas admitted, he made “marks” on his arm because he “no longer wants to live”. The former vice president said: “I have more than seventy death threats. In December, I was demanded, and so I expressed it to the authorities, to pay a vaccine worth twenty thousand dollars so that they don't kill my children or not rape me,” he said.

Under these arguments, the judge of the Multicompetent Unit of the Manglaralto parish, province of Santa Elena, accepted habeas corpus and changed Glas prison for alternative measures, such as regular filing, on Monday of each month, before a judge and the prohibition of leaving the country until his sentences are served.

Jorge Glas was vice president during Rafael Correa's second term and the first months of Lenín Moreno's presidency. The politician was sentenced to six years in prison for unlawful association. The former vice president received USD 13.5 million in bribes from Odebrecht to award them contracts between 2010 and 2012. Glas is subject to an 8-year prison sentence for the Bribes Case 2012-2016, for which Rafael Correa was also sentenced. Glas was convicted of bribery, because while he was Vice President and in charge of the strategic sectors, the entities he was in charge of participated in a bribery scheme aimed at financing Alianza PAIS, Correa's late party.

The defense of Glas is currently appealing the 8-year sentence for the crime of embezzlement in the Singue case, an oil block whose award caused millionaire damage to the State. Glas was a member of the Hydrocarbon Tender Committee that was responsible for the negotiation.

In a meeting with Correista supporters in Guayaquil, where Glas moved to as soon as he left prison in a caravan, the politician said: “If the price for changing this country for 10 years is jail, I accept it. I don't have a shred of regret for what I did for the country. I leave prison with a clean heart of rancor and hatred and I have forgiven everyone who did this to me.”

Government actions

The government of Guillermo Lasso has stated that it will appeal the judge's decision. The Attorney General's Office indicated that it will begin with the necessary actions to “recover money in cases of corruption”. In addition, the Minister of Government, Patricio Jiménez, indicated that “the government categorically rejects the judge's decision in the Glas case” and that they will increase the security of the former vice president so that he does not flee the country.

Despite these statements, the court record indicates that there were three government representatives at the hearing, however, it is detailed that they did not raise any objections.
