
On April 5, the Ministry of Transport and Communications (MTC) approved the Regulations for the Temporary Land Transport Service of Passengers by Collective Car. This establishes the formalization of land transport of passengers by collective car, it had been approved by the Congress of the Republic and will be applied throughout the national territory, with exclusion of Lima and Callao.
Supreme Decree No. 003-2022-MTC was published that same day in the Official Gazette El Peruano, which specifies that the regulation consists of 22 articles and 8 provisions complementary finals.
“The Regulations of the Temporary Land Transport Service for Passengers by Collective Automobile, approved in article 1 of this Supreme Decree, come into force ten (10) working days from the date of its publication in the official newspaper El Peruano”, specifies the rule.
This regulation aims to ensure the safety, integrity and life of people and to reduce the high number of accidents on the roads. Thus, it provides that authorizations to provide temporary service to national and interprovincial groups shall be given when there is an insufficient supply of transport service by regular buses.
REQUIREMENTS FOR DRIVERS
The approved regulation contains the technical, operational and legal conditions that must be met by people seeking to be authorized to provide collective service. It points out that vehicles must have sedan and station wagon bodies (category M1), as well as minibuses with capacity between 10 and 16 passengers and buses from 17 to 30 seats (category M2).
In addition, at national and interprovincial levels, it will be mandatory for vehicles of category M1 to have a net weight of 1100 kg and a minimum displacement of 1600 cc. Vehicles of category M2 must meet a net weight of 2000 kg and a displacement of 2400 cc.
In the interdistrict service, vehicles of category M1 are required to have a net weight of 1000 kg and a minimum displacement of 1500 cc; and those of category M2 are required to have a net weight of 2000 kg and a displacement of 2400 cc.
On the other hand, all qualified vehicles must have ABS (anti-lock system) brakes on all wheels. They also require a wireless control and monitoring system (GPS) that permanently transmits vehicle information on the route to the supervising authority.
The regulation also states that drivers authorized to provide services on national or interprovincial routes may not carry out continuous driving days of more than 5 hours during the day or more than 4 hours at night. Therefore, you must have two drivers when the travel time exceeds the indicated times.
ROUTES FOR GROUPS
At the national and interprovincial levels, routes for the service of groups will be established by the MTC and the regional governments, according to their competence. At the inter-district level, the provincial municipalities will be responsible, which will provide authorizations in accordance with their regulatory route plan. At the national, interprovincial and interdistrict levels, routes must not exceed 200, 100 and 50 kilometres respectively.
It is important to note that only legal entities registered in the Public Registries can obtain authorization to provide this service.
MTC MET WITH GUILDS
On 5 April, the MTC met with different collectives' guilds and signed an agreement announcing changes in the sector. In total, there are seven announcements he gave to MTC:
1. To declare land transport in all its forms and at the national level as an emergency.
2. Reorganize the Sutran to optimize and regulate its functions. Measures regarding ATU and Promomobility will also be evaluated.
3. Reduce the tax on filming.
4. Establish a permanent working table with the carrier guilds.
5. Immediately freeze toll charges on unconcessioned routes run by Provias Nacional.
6. Call on road network concessionaires to review and evaluate concession contracts on toll rates and technical conditions.
7. The Presidency of the Council of Ministers (PCM) would review the Collective Cars Act Regulations to issue the supreme decree.
