In recent hours, Colombian authorities have confirmed that the extradition of Dairo Antonio Úsuga David, alias Otoniel, the top leader of the Gulf Clan, to the United States will take place in “a matter of hours”. This after the Supreme Court of Justice, on Wednesday, April 6, will endorse it.

It should be recalled that Otoniel is required by the US authorities for crimes related to drug trafficking in that country; however, the drug trafficker has tried to evade his extradition. Now, as the time draws near, Dairo Antonio Úsuga has delivered a list of 10 petitions to the Supreme Court of Justice, which he expects will be fulfilled during his time sentenced in the United States.

Otoniel's requests in the event of his extradition were made public after the High Court issued the full judgment, in which he also stated that he has no competence to evaluate his requests, since they are outside its functional orbit and instructed him to submit them to the United States authorities; “to the extent that that these specific aspects are subject to the determination of the foreign authorities”, the Court stressed.

One of the most surprising requests is that Dairo Antonio Úsuga hopes that in the US prison where he is going to be taken, he will be allowed to “have sexual relations with his wife, spouse or permanent partner.”

In addition to this, the drug trafficker asks not to be tried for previous events, that is, that his case only evaluates the crimes for which the extradition request was submitted to Colombia. And, in connection with this, that the sentence or custodial sentence imposed on him does not exceed a time that allows him to be socially rehabilitated, and also that he is not imposed a sentence of exile, life imprisonment, confiscation or death penalty.

Among his requests, he also stressed that he expects that the time he has been detained in Colombia, for the facts to which the extradition request refers, will be deducted from the custodial sentence imposed on him by the United States authorities. In addition, that they do not extradite him to a third country without his approval or that of the Colombian State.

He also asked not to be subjected to torture, cruel, inhuman or degrading treatment, nor does he want to be the victim of unequal treatment based on his nationality and requests to be able to “appoint a lawyer to represent him, who must have the time and means necessary for the defense”.

He added to the petition that he does not want to be “confined to the SHU; the name corresponds to a special unit that implies segregation from the prison population in general.” Finally, he asked to have contact with his family, wife and children, the only petition that the Supreme Court did condition to deliver Otoniel to the United States.

One of the paragraphs of the judgment reads that the defendant is expected to be given “rational and real possibilities to enable him to have regular contact with his closest relatives, since article 42 of the 1991 Constitution qualifies the family as the essential nucleus of society, guarantees its protection and recognizes their honor, dignity and intimacy”.

In the same way, the High Court reminded the United States that Dario Antonio Úsuga has outstanding accounts in Colombia, which is why they expect the authorities of that country to inform the national government when the extradition is effective, so that Otoniel returns to the country and the proceedings against him will not stop.
