Afore: how to collect money from a deceased family member

The Social Security Act stipulated that, in the event of the death of the worker or pensioner, beneficiaries shall be entitled to receive the resources collected in their retirement savings account

In the event that the worker who holds an account with one of the Retirement Fund Administrators (Afore) dies, the resources he collected during his lifetime may be inherited by his beneficiaries registered with the Mexican Social Security Institute (IMSS).

According to the Social Security Act, in the event of the death of the worker or pensioner, the beneficiaries shall be entitled to receive resources that do not have a specific purpose from the individual account of the insured worker or worker, into which the contributions of the employer's retirement savings are deposited, as well as voluntary deposits of workers in order to increase the amount of their withdrawal.

In this way, the beneficiaries established by the Act may be the following family figures:

- Widow or widower, if they have depended on the deceased worker.

- Children under 16 years of age or older than this age if they cannot support themselves by their own work or if they are studying until the age of 25.

- Parents of the worker if they have lived in the same home as the deceased.

- In the absence of a spouse, the concubine or the concubine may also collect the amount of the afore, if the latter depended financially on the worker.

The only requirement to recover the resources is to be entitled to a pension by the IMSS or to have been expressly designated beneficiary by the holder in his afore. Those who wish to start the procedure should follow this procedure:

1. If you are a legal beneficiary, go to the IMSS Sub-Delegation to issue you the corresponding Pension Resolution.

2. Go to the department where the deceased worker was registered with the documents that prove you as a beneficiary and fill out the Resource Disposition form that will be provided there.

3. Once the application has been processed, the Afore shall make available to the beneficiary the resources in a single exhibition corresponding to the pension scheme.

In the event that workers have been pensioned by the Social Security Act 73, the resources shall be handed over in accordance with the following statutes:

- Retirement 97 (resources accumulated from 1 July 1997 to date)

- Housing 97 (resources accumulated from 1 July 1997 to date)

- SAR 92 (cumulative resources from 1 May 1992 to 1 July 1997)

- Housing 92 (cumulative resources from 1 May 1992 to 1 July 1997)

On the other hand, if the pension is under the Social Security Act 97:

- SAR 92 (cumulative resources from 1 May 1992 to 1 July 1997)

- Housing 92 (cumulative resources from 1 May 1992 to 1 July 1997)

If you are not entitled to a pension, all the resources will be given in a single exhibition.

Also, in the absence of legal beneficiaries, the resources will be handed over to the substitute beneficiary directly designated by the worker in the afore and does not necessarily have to be a relative. Once the appropriate beneficiary is identified, you will need to consider the following steps.

However, it is important to note that, in the case of surrogates, you can apply when there are no legal ones. They are not entitled to a pension, but they do have the right to use the resources of the Afore account. In addition, the Federal Conciliation and Arbitration Board will issue the resolution to designate them as beneficiaries of the remedies in these situations
